These Terms of Service (“Terms”) govern your use of the xToolStack website (xtoolstack.com) and any software products sold or distributed through it. By accessing the site or purchasing a product, you agree to these Terms. If you do not agree, do not use the site or purchase any products.

1. Who We Are

xToolStack is operated by Ian Bailey (“we,” “us,” “our”). You can contact us at admin@xtoolstack.com. You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase or use our products.

2. Products and Services

We build and sell software tools, including browser extensions and developer utilities. Each product may have its own specific terms, licensing model, and pricing. Where product-specific terms exist, they take priority over these general Terms for that product.

3. Purchases and Payment

Payments are processed through third-party payment providers (currently Stripe). We do not store your credit card details. By making a purchase, you confirm that you are authorized to use the payment method provided. All prices are listed in USD unless stated differently on the product page. Prices may be subject to applicable taxes (including VAT for EU customers). Any taxes owed are calculated and displayed at checkout.

4. Refunds

All sales of digital products are final. Because our products are delivered electronically and can be used immediately after purchase, we do not offer refunds. See our Refund Policy for full details.

5. License and Usage Rights

When you purchase a product, you receive a personal, non-transferable license to use that product as described on its product page. You may not redistribute, resell, sublicense, or share your license key with others. The specific license terms (number of devices, duration, update entitlements) vary by product and are stated at the time of purchase.

6. Acceptable Use

You agree to use our products and website lawfully and in accordance with our Acceptable Use Policy. We reserve the right to suspend or terminate access to anyone who violates these Terms or misuses our products.

7. Intellectual Property

All content on this website and within our products (including code, design, text, graphics, and trademarks) belongs to xToolStack unless stated differently. You may not copy, modify, reverse-engineer, or create derivative works from our products without written permission.

8. Availability and Updates

We aim to keep our products updated and functional, but we do not guarantee uninterrupted availability. We may release updates, change features, or discontinue a product at any time. If a product is discontinued, existing license holders retain the right to use the last available version.

9. Limitation of Liability

Our products are provided “as is” without warranties of any kind, express or implied. To the fullest extent permitted by law, xToolStack is not liable for any indirect, incidental, special, or consequential damages arising from your use of our products or website. Our total liability for any claim related to a product is limited to the amount you paid for that product.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. If you are a consumer in the UK, EU, or Australia, your statutory rights (including rights under the Consumer Rights Act 2015, the EU Consumer Rights Directive, or Australian Consumer Law) are not affected by this section.

Your use of our website and products is also governed by our Privacy Policy and Cookie Policy.

11. Third-Party Services

Our website and products may interact with third-party services (payment processors, browser platforms, email providers). We are not responsible for the terms, availability, or actions of any third-party service.

12. Dispute Resolution

If a dispute arises, contact us first at admin@xtoolstack.com and we will try to resolve it directly. If we cannot reach a resolution, the dispute will be governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction. If you are a consumer in the European Union, you retain any rights granted by mandatory consumer protection laws in your country of residence. EU consumers may also use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page. The “Last updated” date at the top reflects the most recent revision. Continued use of the site or products after changes are posted means you accept the updated Terms.

14. Severability

If any part of these Terms is found to be unenforceable, the remaining parts stay in full effect.
